Agreement for Participation in Activities

Recitals

  1. The Organization desires protection against any personal liability, claim, suit, action, loss, or damage that may result from the Participant’s participation in the Activities.
  2. The Participant wishes to minimize any hardship the Organization might suffer as the result of any personal liability, claim, suit, action, loss, or damage that may result from the Participant’s participation in the Activities.

In consideration and as a condition of the Participant and the Organization entering into this Agreement, and other valuable consideration, the receipt and sufficiency of which consideration is acknowledged, the Participant and the Organization agree as follows:

Definitions

  1. “Organization” means the following: The corporation 13111946 Canada Inc., operating as The Run Rec, including their respective directors, officers, committee members, members, employees, coaches, volunteers, officials, participants, agents, sponsors, owners/operators of the facility, and representatives.
  2. “Participant” means the following: The legal guardian of the individual(s) who signs this document for their child to participate during the reservation for a time slot at The Run Rec, fully representing (in any capacity as spectators, players, etc.) any and all individual(s) they signed on behalf of who attend the facility during the reserved time, during the Activities.
  3. “Activities” means the following: Reserving and/or spectating during and/or attending and/or playing during the time slot reserved at The Run Rec, located at 283 Northfield Road, Waterloo, Unit 13, Ontario, N2J 4G8, for sports and recreational purposes only.

Release and Assumption of Risk

The Organization is not responsible for any injury, property damage, expense, loss of income, damage, or loss of any kind suffered by the Participant during, or as a result of, the Activities, caused in any manner whatsoever including, but not limited to, the negligence of the Organization.

The Participant understands and acknowledges that the Activities have foreseeable and unforeseeable inherent risks, hazards, and dangers that no amount of care, caution, or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis, and loss of life. The Participant understands and acknowledges that a pertinent risk to participating in the Activities is the risk of suffering serious head injury should the Participant fall, trip, or stumble on the playing surface, or within or around the premises. The Participant agrees to participate voluntarily in the Activities. The Participant acknowledges being aware of the risks, dangers, and hazards associated with or related to the Activities.

Participant's Agreement

In consideration of the Organization allowing the Participant to participate in the Activities, the Participant agrees:

  1. That their physical condition is appropriate to participate in the Activities.
  2. To comply with the rules and regulations for participation in the Activities.
  3. That if they observe an unusual significant hazard or risk, they will remove themselves from participation and bring such to the attention of the Organization immediately.
  4. That the Organization does not undertake to provide health, accident, disability, hospitalization, personal property, or other insurance for the Participant in the Activities.

In further consideration of the Organization allowing the Participant to participate in the Activities, the Participant agrees:

  1. The sole responsibility for their safety remains with themselves.
  2. To assume all risks arising out of, associated with, or related to their participation.
  3. To waive any and all claims that they may have now or in the future against the Organization.
  4. To freely accept and fully assume all such risks and the possibility of personal injury, death, property damage, expense, and related loss, including loss of income, resulting from their participation in the Activities, events, and programs of the Organization.
  5. To forever release the Organization from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, special, and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which they may have now or in the future, that might arise out of, result from, or relate to their participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract, and/or breach of any statutory duty of care of the Organization.

Use of Premises

When reserving a time to utilize the premises owned and operated by BoardHouse, the Participant hereby understands that they are attending and using the facility at their own risk. The Organization shall not be liable for any damage whatsoever arising from any personal injury or property loss sustained by the Participant in or about the premises. The Participant hereby fully and forever releases and holds harmless the Organization from any and all claims, demands, damages, or rights of action, present or future, resulting from the Participant’s use of the facility.

In addition, the Participant agrees to follow the rules and conduct set by the Organization. Failure to do so may result in suspension from participation. The Participant, the undersigned, does hereby authorize the Organization to utilize any and all photographs, pictures, videos, or other likenesses of them as deemed appropriate in its promotional materials.

The Participant certifies that they are 18 years of age or older.

Representation and Supervision

The Participant hereby certifies that they fully represent the minor(s) they brought to attend the facility during the time that has been reserved, for the duration of the Activities.

The Participant hereby certifies that they will vacate the premises in a prompt manner following the conclusion of the Activities. Failure to do so may result in additional fees responsible by the Participant.

The Participant agrees that they are fully liable for any damage caused to, within, and around the premises, including but not limited to fixtures and equipment during the course of the Activities, or during the period of entry and exit from the facility before and/or after the conclusion of the Activities.

The Participant certifies that they are responsible for the supervision of the individual(s) under the age of 18 who they brought to attend the facility during the reserved time slot, whether as a spectator, a player, or for any other purpose.

The Participant acknowledges that the Organization is not responsible for any lost or stolen items.

What are your operating hours?

The RunRec is open 24/7. You can book a court any day and any time.

What is your refund policy?

There are no refunds, no re-bookings, and no cancellation for any bookings that are purchased. If you have additional questions about booking a slot feel free to contact us here.

Can I host my league at The RunRec?

Absolutely! - We welcome all custom leagues to be housed within our facility. Please fill out this form and we will get you setup as soon as possible.

Can I bring weighted equipment to the gym?

Any free-weights, included weighted equipment &/or basketballs are not permitted on the court

What kind of footwear do we need within the facility?

Indoor shoes are only permitted on the court during play. When you enter into the facility make sure to change into the appropriate footwear before stepping on the court.

Are we allowed to eat or drink inside the facility?

Yes - All food & drinks is permitted on the bleacher area (off the hardwood court).

Can I host my training sessions at The RunRec?

Absolutely! - Please fill out this form with all your needs and we will respond to you as soon as possible.

Photography Permits

We believe photography is a great way to capture memories and special moments. However, it’s important to be respectful of other people when taking pictures.

If you’re going to be taking pictures of people, make sure to get their permission first. Nobody wants to have their picture taken without their consent.

That being said, feel free to take pictures inside the facility. Just be sure to respect other people’s privacy and space.

Inappropriate Behaviour

We reserve the right to remove any guests who behave inappropriately from the premises. This includes but is not limited to: trespassing, vandalism, theft, and harassment.

We want everyone to feel welcome and comfortable on our property, and we will not tolerate anything less. Thank you for your understanding and cooperation.

How can I book multiple sessions at one time?

Can I Use the Facility to Teach Yoga?

Yes you can absolutely use our facility to teach other activities! We have a full court as well as two training courts that are multi-purpose and have the space you need to accommodate your class.

So whether you are an experienced instructor or are just considering teaching classes for the first time, we welcome you to use our facility to help your students reach their full potential.

Do I Need to Have Insurance?

We believe your safety is always our top priority. However, we are not responsible for any injuries that may occur while playing in our facility.

We recommend that all participants rely on their own insurance coverage to protect themselves in case of an accident. While our courts are well-maintained and our staff is highly trained, accidents can still happen.

With insurance, you can rest assured knowing you will be covered in an emergency. We appreciate your understanding.
